Legal Separation in New Mexico
Legal Separation follows a very similar timeline to divorce. Orders for property division, child custody, child support, and spousal support must still be entered. However, instead of a final order of divorce, the court grants an order of legal separation.
Legal separation prevents either party from remarrying and can impact benefits, insurance, or other aspects of living separate lives. Cases for legal separation can convert to divorce before or after a final order is entered. Whether or not your case is best served by legal separation or divorce should be discussed with an attorney.
